By downloading, installing, or using Burin Code ("the Application"), or by visiting burincode.com ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application or Website.

Burin Code is a Mac-native desktop application for software development that includes AI-powered coding assistance, code editing, terminal integration, and support for the Model Context Protocol (MCP). The Application runs locally on your macOS device.

You must be at least 13 years of age to use Burin Code. If you are under 18, you must have the consent of a parent or legal guardian. By using the Application, you represent that you meet these requirements.

You retain all rights to your source code, files, and other content ("Your Content"). We do not claim ownership of Your Content. Burin Code processes Your Content locally on your device; we do not access, store, or transmit Your Content through our servers except as necessary to provide account-related services.

You are responsible for maintaining backups of Your Content.

Burin Code offers a Pro subscription tier with bundled AI credits and additional features. All prices are listed in USD. If you purchase a subscription:

Burin Code, including its design, code, documentation, logos, and trademarks, is the intellectual property of Burin Code and its licensors. These Terms do not grant you any rights to our intellectual property except the limited license described above.

BURIN CODE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

You use AI-generated code at your own risk and are responsible for reviewing and testing any code suggestions before use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BURIN CODE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

We may suspend or terminate your access to Burin Code at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco, California.

If you are a resident of Canada, nothing in these Terms affects your rights under applicable Canadian consumer protection legislation.

We may update these Terms from time to time. We will notify you of material changes by posting a notice on burincode.com or within the Application. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
